• ELIGIBILITY. The White Book Challenge ("Contest") is open to all 16-years and older at the time of the entry ("Entrant"). Employees, officers, and directors of Sponsors, their divisions, subsidiaries, parent companies, and affiliates, as well as their family members, and persons living in the same household as employees are NOT eligible. Laws may vary by country, and all federal, state and local laws apply and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsors’ decisions, which are final and binding in all matters related to the Contest (See below in section "Agreement to Official Rules.") Winning a prize is contingent upon fulfilling all requirements set forth herein.
• SPONSORS. The Contest is sponsored by RECCO AB, SE181 04, Lidingö, Sweden ("Sponsor"); Bella Coola Heli Sport, Box 616, Whistler, BC, V0N 1B0, Canada ("Sponsor"); and Quiksilver Inc., 15202 Graham Street, Huntington Beach, CA 92649, USA ("Sponsor"). (Collectively, the "Sponsors".)
• TIMING. The White Book Challenge (Contest") begins at 12:01:00 a.m. Central European Summer Time ("CEST"), August 1, 2006, and ends at 11:59:59 p.m. CEST, April 30, 2007 ("Contest Period"). Entries received after this time will not be considered.
• AGREEMENT TO OFFICIAL RULES. Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. By entering the Contest, entrant warrants that the submission is an original work, has not been previously published or won any award, and that entrant is aware of no conflicting rights in the submission including but not limited to copyright or other intellectual property right as further identified below in the section entitled "No Infringement." Entrants agree that Sponsors, its affiliates, parents, subsidiaries, agents or contractors and their employees, officers and directors shall not be liable for death, injury, loss or damage of any kind resulting from participating in this promotion.
• NO INFRINGEMENT. All Entrants represent, state and agree that their Contest Entry will not infringe upon the intellectual property rights of any third party, including by way of example and not by limitation, any copyright, trademark or patent rights belonging to any third party.
• PUBLICITY. Except where prohibited by law, entry in the Contest constitutes each Entrant’s consent to Sponsors’ use of their names, city and state, and/or country of residence, entry, likeness, photograph, and image for advertising, publicity, and promotional purposes in any media, online or offline, worldwide, without further permission, consent, payment or other consideration, unless prohibited by law. (If Contest winner is a minor, a signed release by Entrant's parent or legal guardian must also be submitted digitally, or faxed to RECCO AB at +46 (0)8 731 05.)
• HOW TO ENTER. During the Contest Period, Entrants must enter by completing the White Book Challenge at www.recco.com. Follow the link, instructions to complete ("Contest Entry"), and submit the registration into the Challenge. Contest Entries become the sole property of the Sponsors. More than one (1) entry is allowed.
• OVERALL AWARD. There will be One (1) Grand Prize. All Contest Entries will be judged by a panel of avalanche experts. The Contest Entry with the highest overall score based upon multiple-choice score plus judgment of panel experts ("Contest Criteria") will be awarded the Grand Prize. Panel experts will select the potential winner at 12:00:00 p.m. CEST on May 15, 2007 at RECCO AB, SE181 04, Lidingö, Sweden ("Potential Winner"). Winning is contingent upon fulfilling all requirements of these Official Rules and Sponsors’ decisions as to the administration of the Contest and prize awards are final. RECCO AB will notify the Potential Winner on or about May 20, 2007, in accordance with the information provided by Entrant in the Contest Entry. In the event that an Entrant’s telephone number or address changes, it is Entrant’s responsibility to notify Sponsors of such change. Potential Winner, or where Potential Winner is a minor, a Parent or Guardian must sign and return an Affidavit of Eligibility, and a Publicity/Liability Release (except where prohibited by law) within 14 days of receipt of those documents or prize may be forfeited. Noncompliance with this time may result in disqualification and prize forfeiture. In the event that RECCO AB cannot contact Potential Winner, or response to a prize notification is not received within 14 days of its issuance, the prize may be forfeited. Where prize is forfeited, the Entrant with the next highest score in accordance with the Judging Criteria will be chosen as an alternate winner. The winner will be announced by news release and will be posted on the www.recco.com web site on or about June 15, 2007. If Potential Winner is a minor, a Parent or Guardian must sign and return an Affidavit of Eligibility, and a Publicity/Liability Release (except where prohibited by law). If Grand Prize winner is under the age of 18, the Winner's guest must be the Winner's parent or legal guardian.
• PRIZE. The winner will receive a 5-day trip for two at Bella Coola Heli Sports and two sets of Quiksilver Gore-Tex® outerwear. Prize and prize components are not transferable or refundable. Sponsors reserve the right to substitute a prize (or prize component) of equal or greater value for any reason. Winner will be responsible for any taxes in effect at the time prize redemption as required by law. Other conditions and restrictions apply. The total value of the prize is $12,000. Where winner is a minor, prize will be awarded in the name of the parent or guardian that signed the original written parental Release.
• TRAVEL AND EXPENSES. Winner is responsible for any and all travel documentation and costs, including having a valid passport/ID/visa. The Winner must provide written notice to request trip dates with Bella Coola Heli Sports at least 90 days in advance. Trip dates are subject to availability. Winner is responsible for all taxes and all other expenses not included in the prize package, including, without limitation, ground and air transportation, parking, meals, room service, souvenirs, phone calls, incidentals, tips, and other personal expenses.
• TERMS AND CONDITIONS. Because this is a contest of skill, odds of winning depend upon the quality and eligibility of submissions received and Entrants' final overall score, as determined by the Judging Criteria for the Grand Prize. RECCO AB reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should fraud, technical failures, or any other factor beyond the reasonable control of RECCO AB impair the integrity of the Contest, as determined by RECCO AB in its sole discretion. In such event, RECCO AB reserves the right to award prizes based on the Judging Criteria from the eligible Contest Entries received up to the time of impairment. BY ENTERING THE CONTEST, ENTRANT AGREES TO RELEASE AND HOLD HARMLESS SPONSORS, THEIR PARENT, SUBSIDIARIES AND AFFILIATED COMPANIES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, CAUSES OF ACTION AND/OR LIABILITY FOR ANY INJURIES, ILLNESS OR DEATH, LOSS OR DAMAGE OF ANY KIND ARISING FROM OR IN CONNECTION WITH PARTICIPATION IN AND/OR ENTRY INTO THE CONTEST OR RECEIPT OR POSSESSION, USE OR MISUSE OF ANY PRIZE OR ELEMENT THEREOF. Sponsors, their respective affiliates, parents, subsidiaries, agents and employees are not responsible for late, lost, illegible, incomplete, stolen, misdirected, illegitimate, or impermissible submissions or mail; postage due mail; or any other error whether human, mechanical or electronic. Contest winner (and their travel companion, if any) may be required to sign a liability release prior to acceptance of any prize. The Sponsors are not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize. Sponsors are not responsible for entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties or other technological glitches.
• DISPUTES: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the Courts of Sweden.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Sweden without giving effect to any choice of law or conflict of law rules (whether of the country of Sweden or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the country of Sweden.
• ENTRANT’S PERSONAL INFORMATION. Information collected from entrants will only be used to contact Potential Winner and to determine the effectiveness of RECCO AB’s promotional efforts.
